Delivering in Saudi Arabia: Residency Has to Be Technically Enforced, Not Contractually Promised

PDPL has been enforceable since 2024 and SDAIA has already issued fines. The NCA requires data residency to be enforced in the architecture rather than agreed in a contract, which changes what you have to build.

Saudi Arabia is the market where the gap between "we are compliant" and "we can demonstrate it in the architecture" is widest, and where that gap is most expensive.

The distinction that decides your design#

The NCA's Cloud Cybersecurity Controls require data residency to be technically enforced, not merely contracted.

That single word changes the engineering. A contractual commitment from a provider that data will remain in the Kingdom is a legal artifact. A technically enforced control is a configuration that makes it impossible for the data to leave, and that can be evidenced on demand.

In practice it means region pinning, policy controls that prevent replication outside the Kingdom, and logging that demonstrates it held. A supplier who answers a residency question with a clause reference rather than a control has not answered it.

Sensitive and personally identifiable data must be stored within Saudi Arabia unless a specific exemption is granted.

This is not a future obligation#

Saudi PDPL has been fully enforceable since September 2024, and SDAIA issued 48 enforcement decisions across 2025 and 2026. Administrative fines reach SAR 5 million, doubled for repeat violations, with imprisonment available for serious breaches.

That enforcement record is the difference between Saudi Arabia and most markets where a law exists on paper. The question here is not whether the regulator will act.

It applies to you even if you are not here. SDAIA enforces PDPL against any organisation processing the personal data of individuals located in Saudi Arabia, regardless of where the company is headquartered. A UK or US business serving Saudi users is in scope.

The infrastructure position is changing right now#

This is the practical difference between Saudi Arabia and the UAE today. Microsoft confirmed Saudi Arabia East availability from Q4 2026, and AWS announced a Saudi Arabia Region planned for 2026.

That timing matters for anything being designed now. A residency requirement that is awkward or expensive today may be ordinary within a year, and the right answer for a system with a two-year life is frequently different from the right answer for one going live next quarter.

We would not design around an announced region as though it had shipped. We would design so that moving to it later is a configuration change rather than a migration, which is a different and much cheaper commitment.

The second framework nobody budgets for#

PDPL sits alongside the NCA's Essential Cybersecurity Controls. Organisations in banking, healthcare and telecommunications must map their controls to the ECC, and sectoral frameworks apply on top.

Teams routinely scope a Saudi programme against PDPL alone and then discover the ECC mapping as a second body of work, usually at the point where a client's security team asks for it.

What we would do differently here#

Treat residency as an architecture requirement, not a contract term. Design the enforcement, then evidence it. If your answer to a residency question is a clause, you will fail the first real review.

Scope PDPL and ECC together. They are separate obligations with overlapping evidence, and doing them as one exercise is materially cheaper than doing them twice.

Design for the regions arriving rather than the regions here. Portability to an in-Kingdom region should be a configuration change by the time it lands.

Where we are honest about our limits#

Our delivery presence in the Kingdom is thinner than in the UAE, and we would rather say so than imply otherwise. For work requiring sustained on-site presence or Arabic-language delivery at scale, we would expect to partner locally, and we would tell you that at scoping rather than after.
